Terms of Service
The ground rules for using Legendary Fly Gear: what the site is and is not, what we ask of you, and what you can expect from us.
Last updated: 24 October 2026 (draft)
About these terms
These terms are an agreement between you and Legendary Fly Gear LLC, a New Jersey limited liability company (“Legendary Fly Gear”, “we” or “us”). They apply whenever you use the site. If you create an account, claim a listing, message a business or advertise, they apply to that too. If you do not agree to them, please do not use the site.
The privacy policy explains how we handle personal information. The community guidelines and the ads policy are part of these terms. If you use the site for a business, you confirm that you may agree to these terms for it.
What Legendary Fly Gear is
Legendary Fly Gear is a discovery directory for fly fishing: waters, guides, fly shops, destinations, gear and stories, to help you plan a day on the water. It is not a booking agent, travel agent, guide service or retailer.
- Most guide and shop listings are built from public sources such as open map data, license boards and the business’s own website. A listing is unclaimed unless it is marked as claimed by the business. Information can be incomplete or out of date: confirm prices, availability, licenses and details with the business before you rely on them.
- Guides, shops, lodges and advertisers are independent businesses. They are not our employees, agents or partners, and we do not train, supervise, license or insure them.
- When you send an enquiry or a business confirms a booking through the site, the agreement is between you and that business. You pay the business directly; we take no payment for bookings and add no fee.
- Prices shown on listings and offerings are set by the business, not by us. Gear prices on checklists are estimates.
Safety and your own risk
Fly fishing, wading, boating and travel to remote water carry real risks, including cold and fast water, flows that rise quickly after storms or dam releases, slippery or unstable banks, drowning, hypothermia, lightning and weather, wildlife, hooks, and being far from help. You decide whether, where and how to fish, and you accept the risks that come with those activities. You are responsible for your own safety and that of the people with you.
- River flows, gauge levels and other readings come from public agencies such as the U.S. Geological Survey. They can be provisional, delayed or wrong, and a gauge may be far from where you fish. They are not a fishing forecast or a safety call.
- A water, access point, map feature or restroom on the site does not mean the place is public, open or safe, or that you may enter it. Get permission for private land, and respect posted closures.
- Nothing on the site is safety, medical, legal or access advice. Before you go, check current regulations, seasons and license rules with the state or national agency, and judge conditions for yourself on the day.
- Before you book a guide, check that they hold any license your state requires, and ask about insurance and safety equipment.
- In an emergency, call 911 or the local emergency number.
Restroom information
Restroom details come from OpenStreetMap and from members. A rating or answer describes what one member saw on one day. We do not inspect restrooms.
- We do not promise that a restroom exists, is open, clean, free, stocked or safe, or that its location is exact. Seasons, fees and rules change.
- “Step-free” and similar answers are members’ own impressions. They are not an accessibility assessment and do not mean a restroom meets any accessibility standard.
- A restroom on our map does not give you the right to cross or use private land.
- When you contribute, share only what you saw yourself, with no people, faces or license plates in photos, and nothing that directs people onto private land.
Your account
You can browse without an account. You must be at least 16 to create one. If you create one, give a real email address, keep your password to yourself, and tell us through the contact form if you think someone else has used it. An account is for one person. You are responsible for what is done with it.
You can download your data or delete your account at any time from Privacy & your data. The privacy policy explains what we store and why.
Acceptable use
Follow the community guidelines everywhere on the site. In short, do not:
- harass anyone, post hate, or share other people’s private details or photos of people who did not agree;
- post spam or undisclosed advertising, or pretend to be another angler, a business or Legendary Fly Gear;
- post a fake rating or review, or one about your own business or a competitor without saying who you are;
- post anything illegal, including poaching, trespass, or out-of-season or over-limit catches presented as a tip;
- post content you do not have the right to share, including other people’s photos or articles;
- claim a listing you do not represent, or give false information in a claim, verification, enquiry, rating or report;
- get around our rate limits, spam checks, blocks or security, or use automated tools to copy listings or other content in bulk, or in a way that disrupts the site;
- use the site to break the law where you are.
What you post
You keep ownership of what you post: trip stories, short reports, comments, messages, photos, restroom ratings, notes and photos, and anything you add to a business listing. Post only your own words and photos, and only photos of people who agreed to be shown. You are responsible for what you post.
So that we can run the site, you give Legendary Fly Gear a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, adapt (for example, resize or crop) and distribute your content on the site, to the audience you chose, including in link previews and, for public trip stories and reports, on Fish Tales pages that search engines can index. Restroom ratings are published without your name. When you delete a post or your account, the license ends for that content, except for copies others have already shared, records we must keep (see the privacy policy), and backups, which are overwritten within 30 days.
Moderation and reporting
What members and businesses post is their own; we do not write it or endorse it, and we are not able to check everything before it appears. Every post, comment, profile, group and message has a Report option, and restroom ratings, notes, photos and added restrooms can be reported too. A person on the Legendary Fly Gear team reviews reports. We may hide or remove content, or restrict, hide or remove a profile, that breaks these terms or the guidelines; when a report is upheld the author is notified.
- Restroom photos, added restrooms and a member’s first few restroom ratings are reviewed before they appear. A restroom rating, note or photo that several members report is hidden until we review it.
- If something of yours was hidden and you think that was wrong, use the appeal form. A person reads every appeal and answers by email.
Messages with businesses
Signed-in members who have confirmed their email address can message a claimed business that takes enquiries, and the business can reply. Keep messages to fishing, trips and the business.
- Until a business has replied to you, your first conversation with a business, and any message of yours that contains a link, email address or phone number, is checked by a person before it is delivered. We limit how many messages can be sent.
- Either side can block the other; then neither can message the other. Use Report for spam, harassment or a scam. We may hide messages and restrict accounts that break these rules.
- We do not guarantee that a business will reply, is available, or will honor a quote. Any booking and payment is between you and the business. Be wary of unusual payment requests, such as gift cards, wire transfers or cryptocurrency, and report them.
- Businesses must answer honestly, honor the prices and terms they quote, and use anglers’ details only to deal with their enquiry or booking. Do not add anglers to a marketing list without their consent.
Business listings and claims
If you run a guide service or shop that is listed, you can claim the listing for free. We verify a claim with a code sent to the email address already on the listing or on its own website domain, or by calling the listed phone number, and a person on our team approves it. We may ask for more proof that you represent the business. Only claim a listing you are authorized to represent.
- A claimed listing is marked as claimed. Details a business reports about itself, such as veteran ownership, are labeled “Self-reported by the business”; ownership details are shown only after a person on our team approves them. The business is responsible for keeping what it adds true and up to date.
- No payment, plan or ad changes where a listing appears in organic results.
- We may correct, hide or remove a listing, or reject or withdraw a claim, if the information is wrong or the rules are broken.
- A business, or a person named in a listing, can ask us to correct it or remove it through the correction form.
What the Verified badge means
A Verified badge means that, on the date shown, a person on our team checked two things: the business’s state guide or outfitter license on the licensing board’s own public lookup (or a source showing that no license is needed for what it does), and that it had liability insurance, from the carrier and expiry date on a certificate it gave us. The badge ends when the license or the insurance expires, unless we check again.
The badge is not an endorsement or a recommendation. It is not a rating of skill, safety or service, not a background check, and not a promise that the license or insurance is still valid or covers your trip.
- We show a business as veteran-owned, service-disabled-veteran-owned or military-family-owned only when its own website says so, the SBA VetCert register lists it, or it told us and a person on our team approved it.
- Where we ask for documents to support a claim or a Verified check, they are used only for that decision, kept in private storage that only our team can see, and deleted once we decide. We keep a record of what we checked and the outcome.
- Giving false information to get a claim or a badge means we remove the badge or claim and may close the account.
Business plans
Business accounts start on a free plan. Paid Verified and Pro plans are planned but are not on sale yet, and nothing has been charged for them. When they go on sale, the price, what it includes, how renewal works and how to cancel will be shown before anyone pays, and these terms will be updated. Veteran-owned, service-disabled-veteran-owned and military-family-owned businesses, once that ownership is confirmed, will get the Verified plan free; the Verified check above still applies.
Advertising
Ads on the site are labeled “Sponsored” and name the advertiser. Every advertiser account and every ad is reviewed by a person before it runs, and must follow the ads policy. We may refuse, pause or remove any ad that does not. Ads are placed by the page they appear on, not by who is reading it, and we do not promise any number of views or clicks unless we agree it in writing.
- Advertisers buy prepaid credit through Stripe Checkout, or approved accounts are invoiced through Stripe. Charges are taken from credit as placements run and are shown in the account’s ledger. Invoices are due within 30 days.
- Unused prepaid credit can be refunded on request to the original payment method.
- Advertisers are responsible for their ads and landing pages being accurate and lawful, including any claims and endorsements in them, and give us a license to display their ad content on the site.
- An advertiser is responsible for claims by others that arise from its ads or landing pages, and will cover our reasonable costs of dealing with them.
Affiliate links
Some retailer links on gear checklists are affiliate links: if you buy after clicking one, we may earn a commission at no extra cost to you. They are labeled as affiliate links where they appear. Your purchase is with the retailer, under its terms. See the affiliate disclosure.
Some links earn Legendary Fly Gear a commission at no cost to you. That includes the hotel, vacation-rental, flight and rental car links in “Plan your stay”, which are marked where they appear. Bookings made there are with the provider, under its terms.
Other websites and services
The site links to and shows content from other websites and services: business websites, public agencies, report publishers, retailers, maps and embedded YouTube videos. We do not control them and are not responsible for their content, availability or practices. Their own terms and privacy policies apply.
Our content, maps and photo credits
The site’s design, text, guides, checklists and the way the directory is put together belong to Legendary Fly Gear or the people who licensed them to us. You may share links and quote short passages with credit.
- Photographs of places are used under their own licenses (public domain, CC0, CC BY or CC BY-SA) and are credited under the photo and on the photo credits page; those licenses, not these terms, decide how you may reuse them. Product photos, logos and business photos belong to the makers and businesses they come from. Videos belong to whoever uploaded them.
- Map and place data include data © OpenStreetMap contributors, available under the Open Database License (ODbL). Map styles and imagery are credited on each map. Data from the U.S. Geological Survey is generally in the public domain.

Copyright complaints
We respect copyright and expect members, businesses and advertisers to do the same. If you believe something on the site infringes your copyright, send a notice through the contact form (subject “Copyright notice”) that includes:
- your name, postal address, phone number and email address, and your physical or electronic signature;
- the work you believe is infringed, and the link to the material on our site;
- a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.
We will remove or disable the material promptly and tell the person who posted it. If your content was removed and you believe that was a mistake or misidentification, you can send a counter-notice the same way, with your name, address, phone number and signature; the removed material and where it was; a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification; and your consent to the jurisdiction of the federal district court for your address (or, outside the United States, any district where we may be found) and to accept service from the person who sent the notice. We may restore the material 10 to 14 business days later unless the complainant tells us it has filed a court action.
We close the accounts of members who repeatedly infringe. Knowingly false notices or counter-notices can make the sender liable for damages. Once we register a designated copyright agent with the U.S. Copyright Office, we will add the agent’s details here.
Disclaimers
We work hard to keep the site accurate and useful, but it is provided “as is” and “as available”. We do not promise that it will always be available, error-free or up to date, or that any listing, reading, rating, story or ad is accurate. We do not guarantee any guide, shop, advertiser, product or trip. River flows, water temperatures and the guidance with them are general information, not a safety assessment or a fishing forecast.
Limitation of liability
To the extent the law allows:
- Legendary Fly Gear is not liable for indirect, incidental, special or consequential loss, or for lost profits or data;
- we are not liable for what businesses, advertisers or other members do, say or post, for your dealings with them, or for conditions on the water;
- our total liability to you for any claim about the site is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US$100.
These limits do not apply to liability that the law does not allow us to limit, such as for our fraud, gross negligence or willful misconduct, or for death or personal injury caused by our negligence where the law does not allow it to be limited. Nothing in these terms takes away rights you have as a consumer that cannot be waived.
If you live in New Jersey
If you are a New Jersey consumer, nothing in these terms limits any right you have, or any responsibility we have, under New Jersey law, including the Consumer Fraud Act, the Truth-in-Consumer Contract, Warranty and Notice Act, the Products Liability Act and the Punitive Damages Act. In particular, the disclaimers and the limitation of liability do not apply to the extent that New Jersey law does not permit them, including for our gross negligence, recklessness, willful misconduct or fraud, and for punitive damages that the Punitive Damages Act allows.
Ending your use
You can stop using the site at any time and delete your account from Privacy & your data; deletion completes after a 7-day grace period. We may suspend or close an account, or remove content, if these terms or the guidelines are broken, to protect members or the site, or if we must by law. Where it is safe and lawful, we will tell you why, and you can appeal through the appeal form. If an advertiser account closes, unused prepaid credit can be refunded on request. Sections that by their nature should continue (such as the license for content already shared, disclaimers and liability) continue after an account ends.
Governing law
These terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules, and disputes go to the state or federal courts located in New Jersey. If you are a consumer, you can also use any court where you live if the law gives you that right, and if you live in the UK or EU, you keep the protection of the consumer laws where you live.
Changes to these terms
We will update these terms as the site changes, and change the date at the top. If a change is significant, we will say so on the site and email account holders it affects at least 14 days before it takes effect, unless a change is needed sooner for legal, security or safety reasons. Changes do not apply to disputes that arose before they took effect. If you do not agree to a change, you can stop using the site and delete your account before it takes effect; using the site after that means you accept the new terms.
General
These terms, with the documents they mention, are the whole agreement between you and us about the site. If a court finds part of them unenforceable, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. You may not transfer your account or these terms to someone else; we may transfer them to a business that takes over the site, and we will tell you if we do.
Contact us
Questions about these terms: use the contact form and a person will reply by email. We do not publish a postal address yet; when we do, it will appear here.
